Regulations of the online store: https://bloomtag.eu

1. General provisions

These regulations define the rules for provision of electronically supplied services, including the rules of selling in an online store available under the Internet domain https://bloomtag.eu (“the Store”), owned by the Bloomtag LLC based in Izabelin – Dziekanowek (post code: 05-092, 39/1 Kwiatowa St., Poland).

 These regulations are addressed to Consumers and specify the rules and procedures  for concluding a distance sales agreement with the Consumer via the Store.

2. Definitions

Consumer – a natural person with full legal capacity, a legal person or an organizational unit without legal personality, but with legal capacity that uses the Store, in particular visits, registers or/and purchases in the Store on terms specified in these regulations;

Seller – Bloomtag LLC based in Izabelin-Dziekanowek, address: 39/1 Kwiatowa St., postal code 05-092, entered into the register of enterprises kept by the District Court for the capital city of Warsaw, 14th Commercial Division of the National Court KRS number: 0000733524, NIP 5311701701, REGON 380315829 with the share capital of PLN 5,000

Customer – any entity making purchases through the Store.

Entrepreneur – a natural person, a legal person and an organizational unit that is not a legal person, for whom the separate grants legal capacity, performs in its own name an economic activity in relation to the Store.

Shop – online store run by the Seller at the internet address www.bloomtag.eu

Distance sales agreement  – a sales contract concluded at distance, on terms specified in these regulations, between the Customer and the Seller.

Regulations – these Regulations of the Store.

Order – Customer’s declaration of intent submitted via the Order Form and aiming directly at concluding a Sales Agreement with the Seller.

Account – customer account in the Store, it contains data provided by the customer and information about orders placed by him in the Store.

Registration form – a form available in the Store, enabling the creation of an Account.

Order form – an interactive form available in the Store that allows placing an Order, in particular by adding Products to the Basket and defining the terms of the Sales Agreement, including the method of delivery and payment.

Shopping Cart – an element of the Store’s software in which the Products selected for purchase are displayed to the Customer.  It enables to set and modify the Order data, in particular, the quantity of products.

Product – a movable item available in the Store / a service being the subject of the Sales Agreement between the Customer and the Seller.

4. Technical requirements

To shop in the Store, including viewing the Store’s products and placing orders, you will need:

  • terminal device with access to the Internet and a web browser
  • active e-mail account ,
  • enabled cookies

5. General information

The Seller, in the widest extent permitted by law, is not liable for any disruptions to this interruption in the functioning of the Store caused by force majeure, unlawful activities of third parties or incompatibility of the Online Store with the Customer’s technical infrastructure.

Browsing the Store’s assortment does not require creating an Account. Placing orders by the Customer for Products in the Store’s assortment is possible either after creating an Account in accordance with the provisions of § 6 of the Regulations or by providing the necessary personal and address data enabling the Order to be completed without creating an Account.

The prices in the store are given in Euro and in Polish zlotys and are gross prices (including VAT).

The final amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including fees for transport, delivery and postal services), about which the Customer is informed on the Store’s pages when placing orders, including  the moment of expressing the will to be bound by the Sales Agreement.

In the case of an Agreement that includes a subscription or provision of services for an indefinite period, the final price is the total price including all payments for the settlement period.

6. Creating an Account in the Store

To create an Account in the Store, you must complete the Registration Form. It is necessary to provide the following data: Name and surname, e-mail address.

Creating an Account in the Store is free.

Logging in to the Account is done by entering the login and password set in the Registration Form.

The Customer may at any time, without giving any reason and without incurring any fees, remove the Account by sending an appropriate request to the Seller, in particular via electronic mail or in writing to the addresses provided in § 3.

7. Placing orders

To place an Order:

  • log in to the Store (optional);

select the Product that is the subject of the Order, and then click “Add to the shopping cart” (or equivalent);

  • log in or use the option of placing an Order without registration;

if the option to place an Order without registration has been chosen – fill in the Order Form by entering the details of the Order recipient and the address to which the Product delivery will take place, select the type of shipment (method of delivery of the Product), enter the invoice data if different from the recipient’s details,

click the “Order and pay” button / click the “Order and pay” button and confirm the order by clicking the link sent in the e-mail,

choose one of the available payment methods and depending on the method of payment, pay for the order within a specified time

8. Payment and delivery

The Customer may use the following methods of delivery or collection of the ordered Product:

  • Courier shipment,
  • Pickup in the InPost parcel locker ( Poland only)

Personal collection, after prior appointment, available at Kwiatowa 39/1, Izabelin – Dziekanówek. Free of charge.

Payment for the order can be made by cash on delivery, card payment, PayU online transfer, PayPal or by traditional transfer to a bank account. Current payment methods are defined on the website of the Store

 

9. Order fulfillment 

  1. Order fulfillment shall be understood as completing all stages of implementation of the order: from the beginning of the fulfillment process of the order, through forwarding the parcel to the courier company, to handing the parcel to the Customer.
  2. The performance of the sales agreement concluded between the Customer and the Seller begins with the preparation of the goods for shipment, which involves the need to credit the Seller’s bank account.
  3. The Customer is entitled to introduce changes in the order or to withdraw it until it is sent.
  4. The Seller is obliged to provide the Customer with goods free of defects.

10. Withdrawal from the agreement

The Customer as a Consumer has the right to withdraw from the agreement within 14 days, without giving any reason and without bearing any costs, except the costs related to costs other than the cheapest random cost of delivery of the goods and direct costs of returning the goods to the Seller. In order to meet this deadline, it is sufficient to send before its expiry a written statement via e-mail: info@bloomtag.eu or by regular mail to the address:  Bloomtag LLC, Kwiatowa 39/1 St., 05-092 Izabelin – Dziekanówek, Poland

In the event of withdrawal from the agreement, the agreement is considered void and the Consumer is released from any obligations. The Consumer is liable for the decrease in the value of the good as a result of using it in the way that exceeds what is a necessity to establish the nature, characteristics, and functioning of the good, unless the Seller has not informed the Consumer about the right to withdraw from the agreement. The deadline for returning payment is 14 days from the day when the Seller receives the statement of the Consumer on withdrawal from the agreement. The Seller may withhold the return of the payment until he receives the returned goods or a proof of its return delivered by the Consumer, depending on which event occurs first. The Consumer does not have the right to withdraw from the agreement:

  • in which the subject of the service was a non-prefabricated item, manufactured according to consumer’s specification or serving to satisfy his individual needs;
  • in which the subject of the service is an item subjected to rapid deterioration or an item of short shelf life;
  • in which the subject of the service is an item delivered in a sealed package, which after opening shall not be returned due to health protection or hygiene reasons if the package has been opened after the delivery.

11.Terms of complaints (notification of defects in goods) 

In case of any complaints, the Customer should contact the Store via e-mail: info@bloomtag.eu, or by regular post sending a letter to the following address: Bloomtag LLC, Kwiatowa 39/1 St., 05-092 Izabelin – Dziekanówek, Poland

The Seller is liable under the warranty if the physical or legal defect of a product is found within two years from the date of delivery of the goods to the Customer.

  • The Customer is entitled to request:
    • exchange of a good for a new one,
    • repair of the goods,
    • price reduction,
    • withdrawal from the contract, if the defect of the good is significant.
  • The Seller shall respond to the claim of the Customer no later than within 14 days. Goods inconsistent with the agreement should be sent back to the following address: Bloomtag LLC, Kwiatowa 39/1 St., 05-092 Izabelin – Dziekanówek, Poland

 

12. Out-of-court ways to handle complaints and redress

Any disputes arising between the Seller and the Customer shall be submitted to the competent courts. The Customer as a Consumer has the opportunity to use the out-of-court complaint and pursue claims by:

Provincial Inspectorates of Trade Inspection, Permanent Consumer Arbitration Courts operating by the Provincial Inspectorate of Trade Inspection, Consumer Ombudsmen, Consumer Federation, Polish Consumer’s Association. Information on the methods of access to the abovementioned procedures are available at the address:  http://polubowne.uokik.gov.pl/.

The Consumer from the EU or Norway, Iceland, and Liechtenstein may also file a complaint via the ODR (online dispute resolution) platform available at the following address: https://ec.europa.eu/consumers/odr/. The European ODR platform constitutes one common access point for consumers and entrepreneurs, enabling out-of-court resolution of contractual disputes arising from online purchases of goods or services.

The consumer has the following exemplary possibilities to use extrajudicial ways to handle complaints and redress:

The consumer is entitled to apply to the permanent amicable consumer court, referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws from 2014, item 148, as amended), with a request to settle a dispute arising from the Contract concluded with the Seller.

The consumer is entitled to apply to the provincial inspector of the Trade Inspection, pursuant to art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws from 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.

13. Final provisions

Agreements concluded via the Online Store are concluded in Polish and English.

The Seller reserves the right to make changes to the Regulations for important reasons as: changes in the law, changes in methods of payment and delivery – to the extent to which these changes affect the implementation of the provisions of these Regulations. The Seller shall inform the Customer about each change at least 7 days in advance.

In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; Act on the Provision of Electronic Services; Consumer Rights Act, the General Data Protection Regulation.
